1.The Seller shall deliver the goods within 3 working days of receipt of payment for the goods, the delivery time to be agreed with the Buyer.
2. The delivery charge depends on the weight, size and delivery distance of the goods.

4. It is important for the customer to provide accurate contact details and delivery address so that delivery is not delayed and the customer can be contacted at the time of delivery
5. If the ordered goods are not in stock, the Customer will be informed of the time when the ordered goods will be received.

The Customer shall have the right to withdraw from the Goods within 14 calendar days of receipt of the Goods if the Goods have not been used within that 14 day period. In order to exercise his right of withdrawal, the Buyer shall notify the Seller by sending a letter of withdrawal.
The Buyer is obliged to return the Goods to the Seller within 7 days after sending the letter of withdrawal by delivering the Goods personally to Motoveikals21, Raiņa iela 16, Jelgava or using courier services. All expenses incurred in returning the goods to the Seller shall be borne by the Buyer.
The Buyer cannot exercise the right of withdrawal in whole or in part if:

the goods ordered cannot be returned by their nature, or are perishable or expendable;

the goods ordered are made or ordered directly for the Buyer on an individual basis;

the goods have lost their original appearance, the packaging of the goods has been damaged or the logo marks of the goods have been torn off, in such cases the Seller shall be entitled to calculate the loss in value of the goods and deduct this amount from the purchase price of the goods.

If a special agreement has been concluded between the Customer and the Seller for the ordering of rare/expensive goods and if the Customer has been warned in advance of any irregularities in the return of the goods.
Article 12(6) of the Consumer Rights Protection Law of the Republic of Latvia states that "the consumer is responsible for maintaining the quality and safety of the goods during the period of exercising the right of withdrawal". The Seller reserves the right to refuse the Buyer to exercise the right of withdrawal or to withhold the refund fee in the event that the goods have been damaged by negligent handling or failure to follow instructions during use, if the original packaging of the goods has been lost or if the packaging of the goods is substantially damaged.

The Buyer orders goods through this website, specifying the type and quantity of goods to be purchased. The Buyer has the option to pay for the goods by direct Klix bank payment from their bank account. This is a fast and secure method of payment which can be used to pay for the purchase online. To make a payment, select your bank, log in and confirm the payment. Klix is a secure bank payment initiator providing a service in accordance with the European Union's Payment Services Directive (PSD 1) - Directive 2007/64/EC. invoice prepared and emailed to the Buyer corresponding to the order. The invoice shall be prepared electronically and shall be valid without signature.

When purchasing goods in the Online Shop, a Distance Contract is concluded between you and the Seller, so please read the terms and conditions governing the transaction. The conclusion of the contract takes place when you tick your consent by completing the purchase processing. If you do not agree to the terms of the Distance Contract, you may place your order without payment and contact us for an individual contract.
1. Terms used in the Contract
Cancellation form - a form of a specified format which the buyer may exercise the right of cancellation by completing and submitting to the seller.
Distance contract - a contract between the seller and the buyer for the purchase of goods in an online shop, which sets out the rights, obligations and responsibilities of the parties.
Online shop - a website operated by the seller with an online shop at www.motoveikals21.lv
Customer - a registered buyer who has provided his/her details to the Seller by completing an online shop registration form.
Terms and Conditions - the terms and conditions of use of the Online Shop.
Order - an order placed in the Online Shop, which includes all the goods that the Buyer wishes to purchase from the Seller and which are specified in a single order, and on the basis of which the Seller sends a confirmation to the Buyer.

Purchase - a paid order containing all the goods the Buyer wishes to purchase from the Seller and specified in a single order.
Goods - the products offered for purchase.
Distance contract
2.1 The Distance Contract is concluded (enters into force) at the moment when the Buyer has made the purchase (payment of the order) in the Online Shop or when the payment for the order is credited to the Seller's bank account in accordance with the payment information received by e-mail
2.2 The Buyer is bound by the current version and terms of the distance contract in force at the time of ordering the goods when shopping in the online shop, and must therefore familiarise himself with the terms of the distance contract each time he places an order. The Seller is entitled to unilaterally change, update and supplement the terms of the distance contract.
3. Registration
3.1 The Buyer may make a purchase in the Online Shop either by registering or by not registering.

3.3 The Buyer is responsible for ensuring that all data provided by the Buyer is true and complete.
3.4 The Seller shall not be liable for any loss incurred by the Buyer in the event that the Buyer has provided incorrect or incomplete data, or if the confirmation or payment information sent to the email address provided by the Buyer is not received
3.5 Registration can be made at the start of payment processing or in the "My Account" section.
3.6 When registering, the registration form must be completed with the following data: name, surname, e-mail address and delivery address. You must choose a username and password. The information provided in the registration form is saved and used for the purchaser's future purchases.
3.7 If the Customer's details change, it is the Customer's responsibility to update them before making a purchase or order.
3.8 If the Customer loses or forgets his/her access data to the Online Shop, it is possible to request a password reset using the "Forgot your password?" option.
3.9 The customer is responsible for the storage of his/her access information (username, password), as well as for any activity carried out in the online shop using the customer's access data.
3.10 The customer is free to change or update his data at any time.
3.11. Non-registered users must re-enter their details for each purchase.
4. Prices
4.1 Prices are quoted in EUR inclusive of VAT. Delivery costs are not included in the price of the goods.
4.2 The Seller shall be entitled to change the prices of the goods in the online shop without prior notice. In the event of a price change, the goods shall be sold to the Buyer at the price prevailing at the time of purchase or order.
5. Placing of Order and Purchase, payment procedure and terms
5.1 When ordering a product, the buyer selects it in the catalogue, adds it to the "Add to basket".
5.2 In the "Shopping cart" section it is possible to view the selected items, change their quantity, remove individual items, choose the method of delivery.
5.3 After all the desired items have been added to the "Basket", payment can be made.

5.5 The Buyer must make payment immediately upon receipt of the payment information, indicating the order or invoice number, if requested.
5.6 Order
5.6.1 When placing an order, if payment is not made for the selected goods, they shall not be reserved.
5.6.2 Upon receipt of payment, the Seller shall dispatch the Goods to the Buyer.

5.7 Purchase
5.7.1 Purchases may be made by both registered and non-registered users.
5.7.2 In the "Order a product" section it is possible to change the delivery address, choose the type of delivery, provide special instructions, for example regarding delivery details, choose the payment method.
5.7.3 After successful payment of the purchase, a confirmation of the purchase is sent to the buyer by e-mail.
6. Delivery
6.1 The Buyer shall pay the delivery charge for the delivery of the Goods, subject to the order being over 50.00 (fifty euros and 00 euro cents) and not exceeding 30 kg

6.3 If the delivery of the goods is delayed due to unforeseeable circumstances beyond the control of the Seller, the Seller shall contact the Buyer and agree on the changes.
6.4 The receipt of the goods shall be confirmed by:
6.4.1. in the case of receipt by courier - the Buyer's signature on the electronic terminal of the courier issuing the purchase or the courier's note of delivery. If any damage to the packaging is detected at the time of delivery, the recipient must inspect the contents of the purchase with the courier and, in the event of damage, ask the courier to prepare a damaged parcel report. The recipient is entitled to return the damaged item to the courier or to keep it if the damage is minor.
6.4.2. When receiving a purchase in a parcel office - the Buyer shall enter the Buyer's own handwritten code to withdraw the purchase. If packaging damage is detected at the time of receipt of the parcel delivery, the recipient must immediately make a claim by filling in the form on the parcel delivery website and contacting the seller.
6.4.3 Upon receipt of a Self-Collection Purchase, the Purchaser shall present the order number or payment details (image) and receive a copy of the receipt for payment, the original receipt confirming receipt of the goods.
6.5 The Buyer is obliged to inspect the quantity, quality and assembly of the goods within 5 (five) working days of receipt of the purchase. If the Buyer discovers any damage or defects in the goods, the Buyer must send a photograph(s) of the clearly visible damage and a description of the problem immediately, but no later than 5 (five) working days from receipt of the purchase, by filling in contact form at motoveikals21.lv. The seller will contact the buyer within 3 (three) working days to resolve the situation. If the Buyer does not submit a claim to the Seller within the specified period, it is assumed that the packaging of the goods is in proper condition and the quantity, quality, assortment, accessories and assembly correspond to the terms of the purchase contract and the description of the goods in the online shop.
6.6 If delivery of the goods is not possible due to the fault of the buyer or circumstances beyond the control of the seller (e.g. the buyer has provided an incorrect delivery address, the buyer or his authorised person cannot be found at the address provided, the buyer cannot be contacted within the time specified, the address provided cannot be accessed, etc.) and the supplier returns the goods, payment for the goods not received and delivery costs shall not be refunded. The goods will be re-sent if the buyer pays for the re-shipment. The buyer is responsible for address correction.
7. Right of withdrawal (for consumers). Exchange and return of goods
7.1 The Buyer may exercise the right of withdrawal and unilaterally withdraw from the distance contract (purchase of goods in the online shop) within 14 (fourteen) calendar days after receipt of the goods.
7.2 The Buyer may not exercise the right of withdrawal for goods made or ordered directly for the Buyer on individual order if the goods have lost their original appearance, the packaging of the goods has been damaged, the logo marks of the goods have been torn off.
7.3 To exercise the right of withdrawal, the Buyer must complete and sign the cancellation veidpagewith the required details and send it to the seller.
7.4 Within 14 (fourteen) days of receipt of the goods, the Buyer shall return the goods to the Seller by post in the same packaging in which the goods were received.
7.5 The Seller shall refund the price of the goods within 14 (fourteen) days after the goods have been accepted for return by transferring the purchase price to the bank account specified by the Buyer.
7.6 The Buyer shall be responsible for maintaining the quality and safety of the goods during the period of exercise of the right of withdrawal. The Buyer shall be liable for any diminution in the value of the goods if the goods have been used in a manner incompatible with the principle of good faith, including use for purposes other than ascertaining the nature or performance of the goods. The seller is entitled to deduct the loss in value from the amount of the refund.
7.7 The Seller shall be entitled not to accept the goods and to refuse the Buyer the right of withdrawal and not to refund the money paid by the Buyer for the goods on 20 May 2014 Cabinet of Ministers Regulation No. 255-22in the cases specified in Paragraph 2.
7.8 The goods must be undamaged, not have lost their appearance and not have been used.
7.9 If the Buyer exercises the right of withdrawal or exchanges the Goods corresponding to the Buyer's order, the delivery charge shall not be refunded to the Buyer.
8. Quality and durability
8.1 The images of the goods in the online shop are for information purposes only. The shape and other characteristics of the goods in the pictures may differ from the actual size, shape and colour of the goods.
8.2 The colour of the product in the photographs may differ from the actual colour of the product. This is due to colour reproduction distortions on different monitors, camera settings and other factors.
9. Goods not in conformity with the Contract
The buyer shall submit the application for non-conforming goods, as well as the non-conforming goods themselves, to the seller in free form, stating his name, surname, residential address and contact details, as well as a description of how the non-conformity is manifested, and shall attach copies of the transaction documents and other documents (if applicable) in support of the application. The buyer shall send the application to the seller at the e-mail address info@motoveikals21.lv. The application will be dealt with in accordance with the procedures and within the time limits laid down in the Consumer Rights Protection Act.
10. Exchange of information
The Buyer shall send all notifications and enquiries via the means of communication and addresses indicated in the "Contacts" section of the Online Shop.
11. Dispute Resolution
11.1 Consumer disputes shall be settled out of court The Consumer Dispute Settlement Commission, address: 55 Brīvības Street, Riga, Latvia, LV-1010.
12. Final provisions
12.1 The Terms and the relationship between the parties hereunder shall be governed by and construed in accordance with the laws of the Republic of Latvia.
12.2 Disputes arising out of or relating to these Terms and Conditions, their breach, termination or validity shall be finally settled in accordance with the procedure established by the laws of the Republic of Latvia.
12.3 The Rules shall be effective from 10 August 2024.
